In 2015, The Texas Commission on Environmental Quality (TCEQ) issued Austin Water a notice of violation for the trees located on and near the berms that contain the Hornsby Bend ponds. To comply with TCEQ requirements, Austin Water developed a solution that seeks to maintain the viability of the water retention ponds and protects the habitat that the ponds provide for resident and migratory birds.
